Court Threatens To Strike Out Dino Melaye’s Suit
Justice Nnamdi Dimgba of the Federal High Court, Abuja, has threatened to strike out a suit filed by Senator Dino Melaye, if the lawmaker or his counsel fails to appear in court on the next adjourned date.
Melaye had filed a suit seeking an interpretation of the court’s judgment of September 11, 2017, which held that Independent National Electoral Commission (INEC) acted within its constitutional right to begin the process of the lawmaker’s recall.
The counsel to INEC, A.Y. Abubakar, on Wednesday notified the court that Melaye’s counsel was not in court and gave no reason for his absence.
He told the court that it appeared that the senator was no longer interested in pursuing the matter.
However, Justice Dimgba said that he would give one more adjournment in the matter.
“I will give one more adjournment and if they are not in court, I will strike it out,” said the judge.
He therefore, adjourned the matter till March 19 and also instructed Abubakar to write Melaye’s counsel and inform him of the new adjourned date.
