Electoral Act: Senate To Appeal Court Ruling On Section 84 (12)

The Nigerian Senate has vowed to appeal the court judgement which ordered the deletion of Section 84 (12) from the Electoral Act.

Recall that President Buhari after signing the amended Electoral Act asked the National Assembly to re-amend the act and delete that section of the law.

The President had claimed that Section 84 (12) violates the Constitution and breached the rights of government appointees.

However, the 9th Senate recently rejected the plea by President Buhari to delete that section of the amended Electoral Act.

In a twist of event, the Federal High Court sitting in Umahia, Abia State, last Friday, directed the Minister of Justice and Attorney-General of the Federation, Abubakar Malami to delete Section 84 (12) of the amended Electoral Act.

During plenary on Wednesday, Senator George Sekibo (PDP – Rivers East) and 80 other lawmakers sponsored a motion to appeal the court judgement on the Electoral Act 2022.

The resolution followed a motion titled: “Urgent need to appeal judgement of the Federal High Court Umuahia on suit no.: FHC/UM/CS/26/2022 on Section 84(12) of the Electoral Act, 2022.”

After deliberations, the Red Chamber resolved to appeal the court judgement that annulled Section 84(12) of the Electoral Act.
