Yahaya Bello’s Government Slams Dangote With Lawsuit

The Kogi State government led by Governor Yahaya Bello has filed a lawsuit against Dangote Industries Limited (DIL), the parent firm of Dangote Cement Plc, over ownership of its cement plant in Obajana, a town in the Oworo district of the Lokoja Local Government Area.

According to PUNCH, the complaint which was filed at the Kogi State High Court, Lokoja Judicial Division, has an originating summons marked HcL/8T/2022.

In the lawsuit dated October 18, 2022, the state government demands that the court should investigate the agreements reached between DIL and the Kogi state government on July 30, 2002, and February 14, 2003, respectively, in order to uncover the fact that due consideration was lacking in the contract.

The government is also asking the court to dissolve the agreement if the aforementioned claim is proven to be true, citing a lack of proper consideration, which is a requirement for a valid contract.

Among the state government’s requests is a perpetual injunction prohibiting Dangote Industries Limited, any of its agents or assigns, from further utilizing and or taking any benefit(s) from the agreement dated July 30, 2002, and February 14, 2003, between the Kogi State Government and Dangote Industries Limited.

The Secretary to the Kogi State Government, Folashade Arike Ayoade, in an affidavit issued supports originating summons that Obajana Cement Company was entirely registered by the Kogi State Government in 1992.
