Court Picks Date To Deliver Judgement On Nnamdi Kanu's Suit Against DSS

Federal High Court, Abuja, has trashed the request of the embattled leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, for the Director-General of the Department of States Services (DSS) to give oral evidence on his state of health, Naija News reports.

At a hearing of a suit filed by the secessionist on Wednesday, Justice Taiwo Taiwo, in ruling, held that fundamental rights cases are special cases “sui generis” which mode of commencement are affidavit evidence as prescribed under Order 2, Rule 2 of the Fundamental Human Right Enforcement Procedure Rules, 2009.

He declined the Biafra agitator’s requested stating that though there were various modes of commencement of action, including fundamental right cases, the applicant (Kanu) chose to commence his “under the Fundamental Right Enforcement Procedure Rules that stipulates affidavit evidence.”

According to the judge, having carefully perused all the affidavits of the applicant and the respondents before him, he was of the view that there were no irreconcilable conflicts in the affidavits.

Justice Taiwo thereby adjourned the matter until April 13 for the hearing of the substantive application.

In another news on Wednesday, IPOB accused its enemies of creating confusion among its members.
In a statement by its spokesman, Emma Powerful, the pro-Biafra group insisted that Nnamdi Kanu remained its supreme leader.

The group described as impostors and fraudsters anyone parading as the new leader of the group.

The group accused the Department of State Services (DSS) of fronting individuals to claim IPOB leadership, Naija News reports.

Powerful said: “We the Indigenous People of Biafra wish to unequivocally state that we have one and only one leader and he is the indefatigable and indomitable liberator of our time, Mazi Nnamdi Kanu. Anybody claiming to be a new leader of IPOB is not only an impostor but also a fraud and should be disregarded and discarded into a waste bin.

“To lead this great IPOB family is neither by talking nor is it by the personal wish of any individual, it is rather a heavenly mandated calling and CHUKWUOKIKEABIAMA chose Kanu to lead his children out of bondage into freedom.

“Anybody being fronted by the Nigerian DSS to parade him/herself as IPOB’s new leader is simply embarking on a self-destructive venture.”
