Sex Toy Shop Assault Was A ‘Simple One’ – Says Sen. Elisha Abbo, Appeals N50m Court Order

The senator representing Adamawa North Senatorial District in Adamawa State, Elisha Abbo has described as ‘simple tort’ the assault done by him on a lady in a sex toy shop last year.

Abbo reportedly said this while appealing the judgment of a Federal High Court in Abuja which ordered him to pay N50m as compensation to the lady he dealt with as shown in a viral video.

Naija News recalls that the young senator was caught on camera in 2019 assaulting one Osimibibra Warmate at a sex toy shop in Wuse 2, Abuja.

Although Abbo had won the criminal case preferred against him by the police before a Chief Magistrate Court in Zuba, Warmate, however, filed a fresh civil suit and Justice Samira Bature of the FCT High Court ruled against Abbo on September 28, 2020, and ordered him to pay N50m and publish an apology to his victim, Naija News reports.

Responding to the compensation N50m to the assaulted lady, Abbo said the facts of the case disclosed an “alleged tort of simple assault” and not torture or inhuman treatment. He thereby appealed the judgement.

Abbo anchored his appeal on three premises: that the judge erred in law when he dismissed his preliminary objection to the effect that the suit was not recognisable under Section 34 of the 1999 Constitution and the fundamental rights enforcement procedure; that the facts of the case were contentious and could not be determined via affidavit evidence; that the trial judge erred when he held that the applicant had proved her case as required by law whereas the evidence was not in her favour.

According to him, the court granting N50m compensation to Osimibibra Warmate was “excessive.”

In another news, the victory of Governor Godwin Obaseki in the September 19 Edo 2020 Election is set to be challenged at the Election Petitions Tribunal by the governorship candidate of Action Democratic Party (ADP), Iboyi Emmanuel.
