Appeal Court Upholds Dapo Abiodun’s Victory

The appeal filed by Adekunle Akinlade against the election victory of Governor Dapo Abiodun has been dismissed on Monday by the Court of Appeal sitting in Ibadan, Oyo State.

It will be recalled that Akinlade contested the March 9 Ogun State governorship election on the platform of the Allied People’s Movement (APM) while Abiodun ran on the platform of the All Progressives Congress (APC).

Delivering judgement in the case on Monday, the three-man panel in the unanimous judgment, delivered by Justice Mohammed Ambi-Usi Danjuma, who stood in for the head of the panel, Justice Abubakar Yahyah, dismissed the appeal filed by Akinlade, for lack of merit.

With the declaration, the appellate court has now upheld the election of the State governor, Prince Dapo Abiodun, as declared by the Independent National Electoral Commission (INEC).

Earlier, the Justice Yusuf Halilu – led Election Petition Tribunal had on September 14 dismissed the petition filed by Akinlade against Abiodun’s victory over failure to prove the allegations.

Akinlade and his party, APM had in a petition marked EPT/OG/GOV/01/19 challenged Governor Abiodun’s victory citing issues of lack of qualification and over voting against Abiodun who was declared winner of March 9 polls.

However, the tribunal dismissed the petition in a unanimous judgement.

“The petitioner failed woefully to prove that the respondent did not score the majority of lawful votes cast and we so hold. “This petition is destined to fail, it failed and it is hereby dismissed,” the tribunal ruling held.

Obviously bot satisfied, Akinlade and his party approached the Appeal Court where they filed 20 grounds of appeal against the Tribunal judgement and asked the court to set aside the tribunal judgement.
