Indigene takes Community Head to Court

Okere community in Warri South Local Government Area of Delta State has issued one of its indigene and businessman, identified as Mr. Eric Kiap, a quit order to vacate his land or face whatever action that results from his refusal to obey the order.
Meanwhile, Mr. Eric Kiap has dragged the Okere community head and two others before a Delta State High Court sitting in Warri, to seek redress.

The defendants (Okere Community) through their counsel, O. G. Fregene, had in a letter dated June 30, 2017, issued and served on the claimant (Eric Kiap) a “Notice to vacate a parcel of land opposite Nana College, Warri,” failing which he would leave himself open “to whatever actions are available.”

However, the petitioner through it counsel, Jolone Ikomi in his statement of claim before the court, stated that the land was granted to his father by the then Itsekiri Communal Land Trust in the 60s, adding that despite attending meetings with the Okere community head and others previously, some persons were sent and forcefully entered into his land and started digging and demarcating the land.

He said that the action led to a dispute that was settled by the Divisional Police officer, DPO, “A” Division Warri until the recent quit order notice.

He pleads with the court to declare the entitlement to the Certificate of Occupancy to the land in dispute held by the plaintiff legal and also restrain the defendants and their agents from further trespassing on the parcel of land known as No. 37 Mabiaku Road, G. R. A., Warri, Delta State.
However, no date has been fixed for the hearing of the matter.
