Court Annuls El-Zakzaky’s Suit Against Nigerian Army

A Federal High Court in Abuja has dismissed a suit filed against the Nigerian Army and three others by the leader of the Islamic Movement in Nigeria (IMN) Ibrahim EL-Zakzaky.

Justice Gabriel Kolawole in his ruling said that the violation of fundamental human rights abuse suit filed by El-Zakzaky against the army and its leadership, Tukur Buratai and two others is an abuse of court process.

However, in his reaction, counsel to the Islamic cleric Festus Okoye said the relief sought by his client at a Federal High Court sitting in Kaduna is different from the one filed in Abuja.

Okoye said his team will however study the judgement delivered by Justice Kolawole and take a decision whether or not to make an appeal against it. The leader of the Islamic group had asked the court to grant a relief that his arrest ad his detention by the Nigerian Army and other security agencies are unlawful.

El-Zakzaky also asked the court to award him a N2 billion as damages for abuse on his fundamental human right infringed on by the agencies. He was arrested and further detained by security operatives in Nigerian after some members of his group clashed with troops of the Nigerian Army on December 5, 2015. El-Zakzaky has since been detained alongside his wife by the Department of State Services (DSS).
